Jenni Kellis and Pat Armstrong (US Cellular RF Engineer) explained the request noting the
following:
* this is a 190 foot tall self support tower
* the 190 foot height is the best height for US Cellular
* the tower will be unlighted (anything over 200’ requires lighting)
* the tower meets the County’s zoning setbacks
* this towers’ service connects to the Dana College Old Main tower to the south; Tekamah water
tower to the north; Hooper tower to the west and no additional coverage is needed along
the interstate to the east
* this new tower is structurally sound to hold up to 3 additional carriers
* the nearby KBLR tower is too short for US Cellular to use for adequate coverage

of County Road 8 west of US Highway 75) be approved with the following
conditions: (1) a certification shall be provided to the County Planning
Department by an engineer stating the tower to be structurally sound and in
conformance with the requirements of the Building Code and all other State \
Federal Codes; and (2) a review in April 2020 (almost 10 years – same as review
for the ATT tower on Highway 133).

PUBLIC HEARINGS:
WASHINGTON COUNTY ZONING REGULATIONS TEXT AMENDMENT
1. Washington County
Washington County Zoning Regulations text amendment, Article 5 Districts, Section 5.03: A-1 Agricultural –
Primary District, subsection 5.03.03 Conditional Uses; add the following: Distillery; and also amend the
Washington County Land Use Matrix to show a distillery as a conditional use in the A-1 Zoning District.
Chairman Lambrecht arrived at this time.
Planning Administrator Cook explained the request noting this is for a proposed text change to the Zoning
Regulations, not any specific site for a distillery.
Carl Brady requested permission to address the Commission regarding zoning regulations about distilleries.
Mr. Brady then distributed to the members a 20-page bound document describing his proposal, relevant
research, and answers to potential issues \ questions the Commission may have. He then inquired as to why
a distillery would not be considered an ethanol plant; and ethanol plants are allowed as a conditional use in
the A-1 District. The Commission related that a “common interpretation“ of the words ethanol plant would
not include a distillery. He continued that the product of a distillery is from an agricultural product. He
reported there are two distillers in the State: Solas in Omaha and Coopers Chase in West Point.
Vice-Chairman Mathiesen opened the public hearing. Carl Brady explained that a Class V license does not
allow retail sales; sales must be made through a Nebraska licensed wholesaler; and has no limit on what, or
the amount of, what can be produced (brandy, vodka, gin, rum, etc.) A Class Z license is limited to 10,000
gallons of production, and allows retail sales. He noted that the County can limit the amount of spirits
produced through a conditional use permit.

and that the sludge will only be stored during the summer.

Highway 133 and south side of County Road 30)
Chairman Lambrecht recognized the staff report.
Sam Mandolfo, applicant, explained the request, noting the following:
* 24% of Nebraska householders do not have a land-line phone
* this proposed tower will improve ATT’s coverage along Highway 133
* this is a monopole tower
* all towers will now have generators in case the power goes out (currently only an 8 hour
battery back-up)
* the next closest ATT towers are in Blair and at the Highway 133 / Highway 36 intersection
Chairman Lambrecht opened the public hearing. Kris Robinson, Building Inspector, inquired about the
type of fuel used for the proposed new generators. Chairman Lambrecht closed the public hearing.

Highway 133 and south side of County Road 30) be approved with the conditions
that: (1) a certification shall be provided to the County Planning Department by
an engineer stating the tower to be structurally sound and in conformance with
the requirements of the Building Code and all other State \ Federal Codes; (2)
that the $25,000 bond be provided to the County Planning Department prior to
the County Supervisors’ hearing on this request; and (3) a review in 10 years.

WASHINGTON COUNTY BUILDING CODES
6. Washington County
Adopt the 2009 IBC (this covers everything - commercial & industrial - but 1 & 2 family dwellings).
(i)Specifically not adopted are Appendix's A, B, D, E, F, G, H, J & K (these are the same as what was not adopted
in the 2003 codes).
(ii) The following Appendix's will be adopted: Appendix C -Group U - Agricultural Buildings; Appendix I- Patio Covers
(this is the same as was adopted with the 2003 codes).
7. Washington County
Adopt the 2009 IRC (International Residential Code for One and Two-Family dwellings).
(i) Specifically not adapted Section R313 - Automatic Fire Sprinkler Systems (page 62). This
entire Section, including all subsections is to be replaced with Section R317-Dwelling unit
separation from the International Residential Code, 2006 Edition.
(ii) Delete Part VIII electrical covering chapters 34 through 43 and Appendix's A, B, D, E, F, I, K,
L, M, N, O, P & Q (these are the same as what was not adopted in the 2003 codes).
(iii) The following Appendix's will be adopted: G - Swimming pools, spas, and hot tubs, H -patio
covers and J - Existing Buildings and Structures (these are the same as what was adopted in
the 2003 codes).
8. Washington County
Washington County Amendments to the 2009 IRC:
(i) Section R202 Definitions. Add the following definition (pg 19) sleeping room. Any room in
the house that is greater than 70 square feet, has a built-in closet space and typically could be
used as a bedroom. This does not include rooms used for cooking, eating, family living or
gathering and excludes bathrooms, toilet rooms, halls, storage, utility and workshop space and
all unconditional space (defined as unfinished area with no electrical, heat or air) space.
(ii) Page 48 Table R301.5 Minimum uniformly distributed live load. Change this table by deleting the number "30"
(live load for sleeping room) and replacing it with the number "40".
(iii) Section R314.3.1 - Smoke Detectors - Alteration, Repairs and Additions- add to exceptions
a number 3 – permits limited to the installation, alteration or repairs of electrical systems are
exempt from the requirements of this Section.
(iv) Section R315.2 Carbon Monoxide Alarms - Where required in existing dwellings, the following exceptions are added:
(1) Work involving the exterior surfaces of dwellings, or the addition or replacement of
windows and doors, or the addition of a porch or deck, are exempt from the
requirements of this Section.
(2) Permits limited to the installation, alteration or repairs of plumbing, mechanical or
electrical systems are exempt from the requirements of this Section.

Adopt the 2009 IPC (International Plumbing Code)

Kris Robinson explained the requests, noting the proposed changes to these national standards:
* 2009 IRC:
add definition of sleeping room
change live load table by deleting the number "30" (live load for sleeping room) and
replacing it with the number "40"
add to exception regarding smoke detectors limited to the installation, alteration or
repairs of electrical systems
add an exemption regarding Carbon Monoxide Alarms for work involving the exterior
surfaces of dwellings, or the addition or replacement of windows and doors, or
the addition of a porch or deck; and permits limited to the installation, alteration
or repairs of plumbing, mechanical or electrical systems
delete the requirement for residential automatic fire sprinkler systems
Robinson noted that these codes can be amended by the County at any time.

Staff requested a June 1, 2011 effective date for these new codes so that contractors could be

Chairman Lambrecht motioned to adopt these codes and County amendments as presented. No second was

Commission members expressed concern that they were hesitant to approve these codes without knowing the
changes that would result by their adoption.

Chairman Lambrecht recognized the staff report.
Wayne Royuk, representing the applicant as Chairman of the Building Committee, presented the request
noting the following: school has been in existence for 135 years; the school is certified by the State of
Nebraska and is accredited by the Missouri Synod; school serves 66 students at this time from pre-school
thru 7th grade; 17 pre-schoolers and 12 kindergartners currently enrolled; within the last year, 120 new
members have joined the congregation mostly young families with children.
He noted that because of this growth, therein lays the need for the proposed temporary classroom.
Royuk stated the proposed temporary classroom is a seven year old manufactured building 28’ x 60’, with
classrooms and ADA restrooms. The building will also allow for expansion to serve children thru the 8th
grade. This building is a short term fix until a permanent addition can be built onto the school. However,
he emphasized, there is no established time frame when that will occur.

Ben Hoffschneider, member of the St. Paul School Board noted that this temporary classroom will be
located behind the school and not easily visible from public roads.

Washington County Zoning Regulations text amendment, Article 2 Construction and Definitions,
Section 2.03 Definition of Terms, add a definition for portable temporary classroom; also amend
the Washington County Land Use Matrix to show a portable temporary classroom as a
conditional use in the A-1 Zoning District.
Staff explained the request noting the Subcommittee of Six has reviewed the item.
The Commission discussed whether to define “school” and just what exactly is a school.

I move the Washington County Zoning Regulations text amendment, Article 2
Construction and Definitions, Section 2.03 Definition of Terms, that the definition
of portable temporary classroom be amended to add the words “state approved”
in the first sentence between the words “a” “school” so that the definition would
read as follows: “Portable temporary classroom shall mean a temporary building,
either stick-built or pre-manufactured (built off-site), installed on the grounds of a
‘state approved’ school to provide additional classroom space where there is a
shortage of capacity. The classroom, as it is temporary (not permanent) and
portable is subject to a time limitation as determined by the County. It does not
need to be on a permanent foundation, but must be properly anchored to the
County’s building codes. It must also meet any other building code or Zoning
Regulation criteria.”

Gordon Andersen, Omaha sludge coordinator, stated Omaha’s product is an anaerobically
digested, semi-solid material that is provided to farmers at no cost. He noted it is the farmers’

Lon Lesher, Chamness Technology, explained that his product is biomass sludge from Cargill.
It is in liquid form and must be immediately injected into the soil.
