ADDENDUM

                                                                                       to

                                              INTER-LOCAL COOPERATION AGREEMENT

                            ENHANCED  (E-911)   EMERGENCY TELEPHONE SERVICE

 

     This Addendum to INTER-LOCAL COOPERATION AGREEMENT ENHANCED

(E-911) EMERGENCY TELEPHONE SERVICE AGREEMENT by and between the

County of Washington, the County of Dodge, the Rural Fire Protection District of

Nickerson, the Rural Fire Protection District of Uehling , and the Rural Fire Protection

District of Winslow, all political subdivisions in the State of Nebraska, and hereinafter

referred to as parties, on this 25th day of July, 1995.

 

     WHEREAS, contemporaneously with the execution of this Addendum, an Inter-

Local Cooperation Agreement Enhanced (E-911) Emergency Telephone Service Agreement

has been executed between the parties, providing for, among other things, an E-911 System

in Washington County, Nebraska, and a 911 service surcharge in an amount not to exceed

$1.00 per month for any local exchange access line physically terminating within Washington

County, Nebraska, but outside of the geographic limits of any village or city in Washington

County, Nebraska, and a 911 service surcharge in an amount not to exceed $.75 per access line

per month for all local exchange access lines physically terminating within the geographic

limits of any villages or cities in Washington County, Nebraska.

 

     The parties hereto agree as follows, to wit:

   1.  Routing of Emergency Telephone Calls:   Telephone subscribers located within the

        certificated exchange area of the Hooper Telephone Company and who are residents

        of Washington County, Nebraska, currently have all of their 911 emergency calls, including

        fire, rescue squad, and law enforcement, routed to the 911 service center located in Fremont,

        Dodge County, Nebraska.  The parties hereby agree that any resident of Washington County,

        Nebraska who receives telephone service from the Hooper Telephone Company shall

        continue to have their 911 emergency telephone calls, including fire, ambulance, emergency

        medical,   law enforcement, or other emergencies, routed to the 911 service center located in

        Fremont, Dodge County, Nebraska ;  and furthermore, the parties hereto specifically waive

        having the emergency telephone calls from such subscribers selectively routed to the 911

        service center in Washington County, Nebraska.

   2.  Transfer of Emergency Telephone Calls:  The parties hereto agree that the 911 service center

        in Fremont, Dodge County, Nebraska, shall transfer or otherwise notify the appropriate

        public safety agency (i.e. fire fighting, law enforcement, ambulance, emergency medical

        or other emergency services) in a reasonably timely manner.  In the event of any law

        enforcement related emergency 911 call, involving a resident of Washington County, Nebraska,

        the parties agree that the 911 service center located in Fremont, Dodge County, Nebraska, will

        immediately relay such call to the Washington County Sheriff's office in Blair, Washington

        County, Nebraska.

   3.  Division of 911 Service Surcharge:  The parties hereto agree that in consideration of the sharing of

        the responsibility set forth hereinabove, any 911 service surcharge assessed on any resident of

        Washington County, Nebraska, who is a subscriber of the Hooper Telephone Company, that:

        (1) the Hooper Telephone Company shall remit any such service surcharge to the 911 service

        center in Fremont, Dodge County, Nebraska; and, (2)  that the 911 service center in Fremont,

        Dodge County, Nebraska, shall remit to the Washington County Treasurer, Washington County,

        Nebraska, an amount equal to one-half of any 911 service surcharge received by such service

        center from or on behalf of the Hooper Telephone Company which surcharge was paid by a

        resident of Washington County, Nebraska, who is also a telephone subscriber of the Hooper

        Telephone Company.

   4.  Duration:  This Addendum to Agreement shall continue and be in full force and effect so long

        as the Inter-Local Cooperation Agreement Enhanced E-911 Emergency Telephone Service

        Agreement, which is executed contemporaneously herewith, shall remain in full force and effect.

   5.  Execution by Counterpart:  The parties agree that this Addendum to Agreement may be

        executed by counterparts signed by all parties and such counterpart shall be affixed to the

        original Addendum to be on file with the County Clerk of Washington County, Nebraska.

 

    THIS Addendum to Agreement executed on July 25, 1995.
